The Constitutional Council of Senegal declared unconstitutional, on Thursday 15 October 2026, the organic law adopted on 1 October to amend the framework governing finance laws. Referred to the Council by the President of the Republic, the court found an irregularity in the voting procedure at the National Assembly.

The ruling covers the entire text, registered under number 38/2026. According to the decision, deputies did not follow the procedure requiring a single vote when the government asks that only the amendments it proposes or accepts be retained.

The Minister of Justice had formally requested that this mechanism be applied on behalf of the government. The executive's amendments were nevertheless put to separate votes and rejected, before the single article of the bill was adopted without incorporating them, the Council notes.

Under Article 82, paragraph 4, of the Constitution, the Assembly had to either approve the text with the amendments thus retained or reject it in its entirety, the judges explain. They consider that the irregularity affects the validity of the law itself, and not only that of the votes on the amendments.

The President of the Republic had filed his appeal urgently on 8 October. The contested amendment concerned organic law No. 2020-07 of 26 February 2020 on finance laws. Decision No. 10/C/2026 provides for its publication in the Official Journal.
